Husky Energy submitted a project description for a proposed 2D or 3D seismic survey, vertical seismic profiling and geohazard well site surveys in the Jeanne d’Arc/Flemish Pass Area offshore Newfoundland and Labrador from 2012 to 2020. The project was listed on the Inclusion List Regulations under the Canadian Environmental Assessment Act (S.C. 1992, c. 37) (CEAA) and required a Screening level of assessment.

On July 6, 2012, the Canadian Environmental Assessment Act (S.C. 1992, c. 37) was repealed when the Canadian Environmental Assessment Act, 2012 (CEAA 2012) came into force on July 6, 2012.

Environmental assessment (EA) for the Husky Energy Jeanne d’Arc Basin / Flemish Pass Regional Seismic Program, 2012-2020 is no longer required federally as a result of CEAA 2012. However, all other applicable legislative, regulatory and constitutional requirements still must be fulfilled. In particular, safety and environmental protection are priority responsibilities of the C-NLOPB pursuant to the Accord legislation, and the C-NLOPB still must consider the potential environmental effects of activities that are proposed for its authorization.

Accordingly, the C-NLOPB will be continuing and completing environmental assessments that were ongoing pursuant to the Canadian Environmental Assessment Act prior to July 6, 2012.
