Regulations

The new Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations will be coming into force on January 1, 2022.  In addition, the following transitional regulations will be automatically repealed on December 31, 2021:

  1. Canada – Newfoundland and Labrador Offshore Area Diving Operations Safety Transitional Regulations
  2. Canada – Newfoundland and Labrador Offshore Marine Installations and Structures Transitional Regulations
  3. Canada – Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations

As a result, there is a new hyperlink to the Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations included below, and the three transitional regulations will be removed on the first business day following their repeal (January 4, 2022).

In the event of any inconsistency between an obligation imposed by the Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations and an obligation in respect of occupational health and safety that is imposed by the Newfoundland Offshore Petroleum Installations Regulations or the Newfoundland Offshore Petroleum Drilling and Production Regulations, the Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations shall prevail, regardless of whether the obligations are imposed on the same person.  Further, in the event of any inconsistency between the Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations and information provided in guidance, Interpretation Notes or Codes of Practice, the Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations shall prevail.  References to any of the transitional regulations in documents and hyperlinks on this website should be read as the corresponding equivalent provision in the new Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations.  Over the first quarter of 2022, these references to the transitional regulations will be updated to reflect the new Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations and redundant information removed from our website upon promulgation of the Guidance document supporting the new Canada–Newfoundland and Labrador Offshore Area Occupational Health and Safety Regulations.

On October 28, 2020, Transport Canada’s Navigation Safety Regulations, 2020, came into force establishing additional or complementary standards to those set out in the International Convention for the Safety of Life At Sea of 1974 and the Protocol of 1988 relating to the International Convention for the Safety of Life At Sea of 1974. These new regulations replace the Ship Station (Radio) Regulations, 1999, the Ship Station (Radio) Technical Regulations, 1999, and the VHF Radiotelephone Practices and Procedures Regulations which have been repealed. Consequential amendments were also made to subsections 36(4) and (5) of the Newfoundland Offshore Petroleum Installation Regulations whereby radio communication systems onboard the installations are now required to comply with the requirements of the new Navigation Safety Regulations, 2020.
