1. Introduction:

The White Rose Project will be subject to review under legislation under the Atlantic Accord and the Canadian Environmental Assessment Act (CEAA) . The review process will consist of three components: an environmental assessment under the CEAA in the form of a Comprehensive Study Report (CSR); a public review under legislation under the Agreement, and an internal review by staff of the Canada-Newfoundland Offshore Petroleum Board. The attached diagram gives a description of the process.

The Enhancement Application includes the following five documents:

1. Economic Benefits Plan,
2. Development plan,
3. Environmental Impact Statement,
4. Statement of Socio-Economic Impact,
5. Security Plan and Project Security Analysis.

The Office will first verify that the information submitted is complete. In the event of deficiencies, he will inform the promoter and ask him to fill them if necessary. The completed application will then be made available to the public and submitted to the Commissioner for Public Review. The Board will undertake its own review of the application at the same time.

At the end of the process and in light of the public review and internal review, the Board will make its decision known in the Decision Report. It will be either the approval or the rejection of the proposal. If the Board approves the proposal, with or without conditions, its decision will be submitted to the federal and provincial ministers of energy, who will either approve it or reject it.

2. Public review

The Board has appointed a Commissioner for Public Review of the White Rose Enhancement Project under section 44 of the Implementation Acts. The public review process is intended to provide all interested parties with the opportunity to learn about the Development Project and to share their views on the proposal.

The mandate of the Commissioner is explained in Appendix 3 .

The Commissioner will hold public hearings in areas of the province affected by the Project and will report these hearings to the Board as well as to the Federal and Provincial Ministers of Energy.

The Commissioner will make recommendations on issues such as the proponent’s proposed approach to resource development and exploitation, measures incorporated into the design and operation of the production system for safety, environmental impacts, and economic benefits for the province and Canada. The Commissioner’s mandate does not include consideration of matters relating to energy policy, areas of jurisdiction, taxation, royalty or revenue sharing between the Government of Canada and the Government of Newfoundland and Labrador .

3. Internal review by the Office

The Board is required to review all aspects of the Development Application under the Acts under the Agreement. To this end, Agency staff will conduct an internal review of the Development Plan and the Benefits Plan, which will include reservoir management, reconnaissance drilling, economic benefits for Canada and more. and Newfoundland, environmental impacts, environmental protection, production systems and safety plans. The Agency will also consult with relevant government departments and agencies or other specialists as it deems appropriate, and in particular relevant government departments and agencies with respect to Benefits Plan issues.

4. Évaluation environnementale

L’évaluation environnementale du Projet White Rose couvrira les exigences environnemntales de la LCEE et celles des lois de mise en oeuvre. Ce processus a été amorcé en mars 2000 lorsque le promoteur du projet, Husky Oil Operations Limited, a présenté une description du projet.

Les ministères et organismes visés par la LCEE doivent déterminer d’après la description du projet si une évaluation environnementale est nécessaire en vertu de la Loi et, le cas échéant, s’ils possèdent, selon toute vraisemblance, des compétences particulières qui faciliteraient cette évaluation. Le Règlement sur la coordination fédérale de la LCEE précise comment la détermination et les communications doivent se faire.

Les ministères et organismes qui sont tenus d’évaluer des projets sont désignés des « autorités responsables » (AR). Dans le cas du Projet de mise en valeur de White Rose, les AR sont l’Office (l’AR principale), Environnement Canada, Pêches et Océans Canada, et Industrie Canada. La LCEE exige qu’une étude approfondie qui prévoit des consultations publiques soit menée, et qu’un rapport d’études approfondies (REA) soit préparé.

En se fondant sur la description du projet et, conformément au processus prescrit dans le Règlement sur la coordination fédérale , l’Office et les autres AR du projet ont préparé un document (trousse de détermination de la portée) précisant la portée de l’évaluation environnementale qu’ils ont soumis au promoteur afin qu’il puisse s’en servir pour préparer le REA. L’esnemble des documents de détermination de la portée a été versé dans le registre public des évaluations environnementales. Pour obtenir la liste des documents dans le registre, il suffit de communiquer avec l’Office au (709) 778-1400. La description du projet est présentée dans le site Web du promoteur à : www.huskywhiterose.com. . Dans le cadre de l’élaboration du REA, le promoteur était chargé de consulter le public et les parties intéressées au gouvernement, et de veiller à ce qu’il soit bien tenu compte de toutes les préoccupations soulevées en matière d’environnement.

Le promoteur a soumis le REA provisoire à l’Office en octobre 2000. L’AR et les autres organismes gouvernementaux possédant des compétences connexes sont en train d’examiner le rapport pour s’assurer qu’il respecte le document de détermination de la portée. Une fois cet examen terminé, l’Office, au nom de toutes les AR, présentera le REA final à l’Agence canadienne d’évaluation environnementale (ACEE) de même qu’au ministre fédéral de l’Environnement. L’Agence mettra le REA à la disposition du public afin de s’assurer de la conformité du rapport à la LCEE . Après ces étapes et à la suite des modifications éventuelles découlant du REA, le ministre de l’Environnement déterminera si le REA peut être renvoyé aux AR ou s’il doit faire l’objet d’une évaluation environnmentale plus poussée en commission.

Si le ministre de l’Environnement décide de renvoyer le REA aux AR, le commissaire de l’Office entreprendra les audiences publiques. Si le minsitre détermine qu’une évaluation environnementale plus approfondie en commission est justifiée, l’Office et le ministre de l’Environnement élaboreront un processus conjoint d’examen public.

5. Décision de l’Office relative au Plan de mise en valeur

L’Office présentera sa décision relative au Plan de mise en valeur dans son rapport de décision. En vertu des lois de mise en oeuvre, le Plan de mise en valeur de la Demande de mise en valeur doit être approuvé par le Ministre avant d’être mis en oeuvre.
