Having received the Agreed Statement of Facts, the C-NLOPB is advising that on September 5, 2024 Suncor Energy Inc. (Suncor) pled guilty to the following charges stemming from a December 29, 2019 incident, when a worker was injured following a fall from a ladder while conducting gas testing onboard the Terra Nova FPSO, in the Canada-Newfoundland and Labrador Offshore Area:
Charge #1
On or about December 29, 2019 at or near the Terra Nova FPSO, in the Exclusive Economic Zone of Canada, in the offshore area off the Coast of Newfoundland and Labrador, did not take all reasonable measures to ensure the health and safety of its employees and other individuals, contrary to section 205.018(a) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation Act, S.C. 1987, c.3, thereby committing an offence pursuant to paragraph 205.104(1)(a) of the Canada- Newfoundland and Labrador Atlantic Accord Implementation Act S.C. 1987, c.3.

On or about December 29, 2019, at or near the Terra Nova FPSO, in the Exclusive Economic Zone of Canada, in the offshore area off the Coast of Newfoundland and Labrador, being unable to comply with 160(1) (a), (c) (e) and (f) of the Canada-Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations SOR/2015-1, did not ensure that every employee entering into, exiting from, and occupying a confined space wore a safety harness that was securely attached to a lifeline that was attached to a secure anchor outside the confined space, contrary to subsection 161 of said regulations, thereby committing an offence pursuant to paragraph 205.104(1)(a) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation Act S.C 1987,c.3
These charges followed an investigation by C-NLOPB Occupational Health and Safety Officers.
A fine of $45,000 was imposed for each charge under the Accord Act for a total of $90,000. In addition, Suncor was ordered to pay $20,000 to the College of the North Atlantic Health and Safety Management Program.
The C-NLOPB is the independent regulator of petroleum activities in the Canada-Newfoundland and Labrador Offshore Area, on behalf of the federal government and the Government of Newfoundland and Labrador.
